NOTICE OF PUBLIC HEARING

INTENT TO SELL OR LEASE REAL ESTATE

DAYTON LEARNING CENTER AND

LOT IN CHIMNEY ROCK AREA

The Rockingham County Board of Supervisors will hold a public hearing at its meeting on May 23, 2018, at 7:00 p.m. at the Rockingham County Administration Center, 20 East Gay Street, Harrisonburg, Virginia, to take public comment on the Board’s intention to declare surplus and sell, transfer, lease long or short term, or otherwise convey all or a portion of its interest in two parcels of real estate.  Parcel No. 1 is commonly known as the Dayton Learning Center.  Many years ago Parcel No. 2 was known as the Chimney Rock School.


Any party interested in purchasing Parcel No. 1 shall submit a sealed purchase proposal no later than 5:00 p.m. (EDT), May 22, 2018.  Proposals shall include intended use and may include purchase structuring other than payment in full at closing such as, but not limited to, lease to purchase.  Proposals will be evaluated on all relevant factors and will not be determined solely on price.  The County reserves the right to reject all proposals.


Any party interested in purchasing Parcel No. 2 shall submit a sealed bid no later than 5:00 p.m. (EDT), May 22, 2018.  The County reserves the right to reject all bids.  If conveyed, Parcel No. 2 will be conveyed with a restriction that no structure will be permitted to be built on Parcel No. 2.


Following the public hearing the Board of Supervisors will consider whether to declare either or both parcels surplus and, if so declared, whether to accept a proposal submitted for Parcel No. 1 or a bid submitted for Parcel No. 2.  Consideration of whether to declare surplus, or whether to accept a proposal or bid, may be continued to another Board meeting.


Parcel No. 1 is more particularly described as follows:


All those tracts and parcels of real estate known over the years as the Dayton Learning Center located at 290 Mill Street in Dayton Virginia, containing approximately 4.2 acres of real estate, also known as tax map parcel 107D2-(A)-L10.  Source deed information is being confirmed as of the drafting of this public notice.


Parcel No. 2 is more particularly described as follows:


All that certain tract or parcel of land, containing 43,559 square feet, together with the improvements thereon, located north of Route 259 and on the western bank of Runions Creek about four miles west of Broadway, in Plains District, also known as tax map parcel 38-(A)-24A, being the same parcel conveyed to the County by a deed dated December 20, 1998 from Jane H. Van Orden Smootz, which deed is recorded in the Clerk’s Office of the Circuit Court of Rockingham County Virginia, in Deed Book 1670, at Page 374.


This public hearing is being held pursuant to Virginia Code Section 15.2-1800.
